EB-5 Investment Visa Advisory

Many foreign nationals have an interest in obtaining permanent U.S. residency for a variety of reasons, from having access to America’s top schools and universities, to its world famous cultural centers, and to its unsurpassed investment and work opportunities.
The EB-5 Investment Visa offers unique advantages to foreign investors over other U.S. visa programs, including:
- The freedom to live, work and retire anywhere in the United States.
- Children under the age of 21 may attend U.S. colleges and universities at resident costs.
- A direct path to permanent U.S. residence for an investor and his/her immediate family members under the age of 21.
- The freedom to travel outside of the U.S. and return without a visa.
- A pathway to U.S. citizenship after 5 years of being a Green Card holder.
- No language, minimum education, or business/management experience requirements.
- No quota backlogs (there are multi-year backlogs for many employment and family-based Green Card categories).
- The investor can develop and run his or her own business.
- The investor does not need a family member or employer to sponsor him or her.
- The investor can sponsor Green Cards for his or her relatives.
- Investment capital can come from a gift, inheritance, business ownership or any other lawful activity.
- The investor is not required to manage the investment on a daily basis, allowing him or her to pursue other professional and personal ventures.
The two investment-based immigration programs available to foreign investors include:
1. Direct Investment: An investment of at minimum $1,000,000 into a new U.S. business enterprise (unless the investment is being made into a rural area or an area stricken with at least 150% of the national unemployment rate, known as a “Target Employment Area”).
2. Pilot Program Regional Investment Center: An investment of at minimum $500,000 into a USCIS-approved Regional Investment Center (part of a “Target Employment Area”).
